Ein Besuch im Luftfahrt-Museum! Ein sensationeller Fund! Aber: Darf ich diese Fotos veröffentlichen? NN · 1998 (Fotos: © NN · Tableau © PP · www.ewigesarchiv.at) Vor ein paar Tagen schaute ich nach Längerem wieder in die mit „Gefundene Negative/Filme“ beschriftete Archiv-Box und ließ einige der dort aufbewahrten Pretiosen beim Fotolabor meines Vertrauens, beim cyberlab verscannen (Ja – ich quengle dort immer um ein paar Prozente und will mich irgendwie dafür revanchieren ;-) Die Vorfreude auf die Scans ist immer riesengroß – diesmal waren einige absolute Top-Funde dabei, zB. 8 eindeutig thematisch zusammengehörige Fotos, augenscheinlich aufgenommen während eines Besuches in einem Aviatik-Museum. Der einbelichtete Zeitstempel: 12. 1. ’98. Die abgebildeten Personen sind mir unbekannt, ebenso der Ort, an dem sich das Museum befindet. Die an manchen Aufnahmen lesbare Objektbeschriftung ist in englisch. Vermutlich ließe sich das Museum herausfinden, doch das liegt nicht vordergründig in meinem Interesse. Es geht um ein Thema, das mich seit vielen Jahren beschäftigt: Wie verfahre ich mit Fotografien, deren Urheber*innen ich nicht kenne, ich nicht mehr befragen kann über die Umstände der Aufnahme. Selbstverständlich auch von Wichtigkeit: Darf ich diese Fotos veröffentlichen – grundsätzlich und auch hinsichtlich der DSGVO – der Datenschutz-Grundverordnung.

Zum Thema „Fotografie und Datenschutz“ sind vor wenigen Tagen zwei Blogs von Rechtsanwälten im STANDARD veröffentlicht worden, die unterschiedliche Standpunkte vertreten – beide Beiträge fand ich interessant.

NN · 1998 (Photos: © NN · Tableau © PP · www.ewigesarchiv.at) A few days ago I looked again into the archive box labeled “Negatives / Films found” and left some of the treasures stored there at the photo laboratory I trust cyberlab to scan it (Yes – I always quack a few percent there and somehow want to return the favor 😉 The anticipation for the scans is always huge – this time some absolute top finds were there, e.g. 8 clearly thematically related photos, apparently taken during a visit to an aviation museum. The imprinted time stamp: January 12, ’98. The people depicted are unknown to me, as is the location of the museum. The object labeling that can be read on some recordings is in English. Probably the museum could be found out, but that is not primarily in my interest. It’s about a topic that has preoccupied me for many years: How do I deal with photographs whose authors I do not know, I can no longer ask about the circumstances of the photo. Of course, also of importance: May I publish these photos – in principle and also with regard to the GDPR – the General Data Protection Regulation.
A few days ago, lawyers published two blogs on the subject of “photography and data protection” in STANDARD, which represent different points of view – I found both posts interesting.
