Wie ein Film, von dem ich Rechteinhaber und Produzent bin, ohne meine Zustimmung kopiert, grob im Format beschnitten, automatisch koloriert, willkürlich editiert, mit Text und Musik versehen auf TikTok veröffentlicht, dort massenhaft gesehen, geliked und weitergeleitet wurde – und wie ich darauf reagiert habe. Tru Story. Wien | AT · 1976–2026 (links SW-Bilder © PP; rechte Seite: ungefragte Bearbeitung und Veröffentlichung R.D.; screenshots: PP; # 3833 · www.ewigesarchiv.at) Die Vorgeschichte (Kurzversion): 1976 arbeitete ich an einem Abend in der Woche in Jugendzentrum Pantucekgasse in Wien Simmering in der Nähe des Zentralfriedhofes. Dort machte ich mit Jugendlichen einen Film, gab ihnen meine N-8 mm Kamera, sie filmten sich selbst, fuhren mit der Kamera durch die Gegend etc. Den fertigen Film schauten wir uns gemeinsam an, redeten darüber und führten ihn im JZ vor. Jahre später ließ ich den Film digitalisieren, schnitt nur die Klebestellen heraus, editierte ihn aber sonst gar nicht. Der Künstler und Musiker Helmut Stadlmann steuerte Musik bei – ich veröffentlichte den Film auf YouTube, wo er großen Zuspruch erhielt. Daraufhin bat mich das Filmarchiv Austria, diesen Film an ihre Platform Filmarchiv Austria ON zu übergeben, wurde auch dort veröffentlicht und außerordentlich oft gesehen. Gestern wurde ich aufmerksam gemacht, dass auf TikTok eine völlig veränderte, kolorierte 1-minütige Version kursiert. Ich versuchte, den unter dem Alias R.D. (abgekürzt) agierenden Veröffentlicher zu kontaktieren, die Nachricht wurde aber von TikTok unter Verweis auf angeblichen Verstoß (meiner Nachricht!!) gegen Community Richtlinien nicht weitergeleitet. Schließlich konnte ihm derjenige, der mich daraufhin aufmerksam gemacht hatte, eine Nachricht schicken. Daraus entspann sich folgender Kontakt, den ich hier ungekürzt (ohne Realnamen) veröffentliche.

„Alle meine Videos haben irgendeinen Urheber.“

Wenn ich da jeden erst rausfinden müsste und erst fragen würde könnte ich fast nichts hochladen weil fast niemand das erlaubt oder Geld verlangt“

„Ich verdiene aber daran nichts im Gegenteil das bearbeiten kostet mich sogar, ist reines Hobby.“

Ich glaube auch nicht dass der Herr zustimmen wird.

Ich habe einen privaten nicht kommerziellen Tik Tok Kanal wo ich alte Videos aus Wien zeige und wenn sie schwarz weiss sind coloriere ich sie.

Dürfte ich Szenen aus ihrem Film von dem Jugendzentrum in Simmering aus 1976 diesbezüglich verwenden?

Das video, das Sie kopiert, ausschnittsweise editiert, im format geändert haben, koloriert, mit text + anderer Musik versehen + ohne Rückfrage + ohne schriftliche Zustimmung auf TikTok ohne jeglichen verweis auf copyright / Urheber + Hintergrundinformation veröffentlicht haben, wo es derzeit 16.4 K zugriffe hat, dieses video 

> wurde vor mittlerweile 50 jahren unter meiner Leitung + auf meine initiative hin von jugendlichen des JZ Simmering in der Bunten Schule mit meiner Normal 8 mm Kamera gedreht, das Filmmaterial wurde von mir gekauft + entwickeln lassen + mit den Jugendlichen der film besprochen

> ich habe diesen analogen film über viele jahre lang sachgemäß archiviert und aufbewahrt

> viele jahre später habe ich diesen N 8 mm film digitalisieren lassen – gegen Bezahlung natürlich

> vor etwa einem jahr habe ich Schnittstellen (Klebestellen) herausgenommen, aber in keiner weise den film editiert 

> ein Komponist und Musiker hat den film vertont

> ich habe den film veröffentlicht (Sie haben ihn vermutlich aus ytb downgeloadet )– er ist sofort auf großes Interesse gestoßen

> ich bin daraufhin vom Filmarchiv Austria kontaktiert + gebeten worden diesen film dem Filmarchiv Austria für deren Plattform Filmarchiv ON zu übergeben – wo er auch vor einigen Monaten veröffentlicht wurde und der trailer schon in den ersten tagen mehr als 40 K zugriffe hatte.

> ich betreibe seit 1980 das Projekt Das Ewige Archiv. www.ewigesarchiv.at – eine sehr umfangreiche, unabhängige website – eine Enzyklopädie zeitgenössischer Realitäten und stelle international aus.

> Ich realisiere seit mehr als 10 jahren Dokumentationen, die teils im ORF gezeigt werden (s. Website etc)

> ich werde fallweise von Filmproduktionen – zuletzt auch von einer deutschen Produktion – angefragt um Lizenzierungen von Sequenzen – insbesondere auch von historischem Material wie diesem von Ihnen ungefragt kopiertem und völlig verändertem Material.

> Ihre ungefragt vorgenommenen unzähligen Änderungen verändern und verstümmeln den Film respektlos in geradezu grotesker und nicht hinnehmbarer weise

Sie schreiben:

Anmerkung: 

es sind eben NICHT IHRE Videos, die Sie umfärben, croppen, beschneiden, editieren etc – diese Filme HABEN alle Urheber*innen.

Filme entstehen nicht von selbst.

Wenn ich da jeden erst rausfinden müsste und erst fragen würde könnte ich fast nichts hochladen weil fast niemand das erlaubt oder Geld verlangt“

Anmerkung: 

das heißt: Sie gehen davon aus bzw wissen, dass niemand das erlauben würde – und ersparen sich das fragen + sind überzeugt davon, dass Sie das trotzdem oder gerade deswegen machen können bzw.: Sie machens einfach.

Sie setzen sich über Urheberrechte hinweg, verwenden ungefragt die Arbeit anderer, verändern sie krass, rücksichtslos- und respektlos, verändern (historisches) material nach belieben – und veröffentlichen Ihre bunte Mischung OHNE angabe der urheber*innen unter IHREM pseudonym / avatar RAIN D

„Ich verdiene aber daran nichts im Gegenteil das bearbeiten kostet mich sogar, ist reines Hobby.“

Anmerkung:

Weil Sie angeben, nichts daran zu verdienen – erscheint ihnen Ihr vorgehen gerechtfertigt.

Es ist für mich und alle anderen urheber*innen völlig unerheblich, ob + wieviel Sie verdienen – es entsteht in jedem fall auch ein materieller schaden für den/die urheber*innen durch die unerlaubte Verwendung + Veränderung des Materials – es entwertet jedes material in erheblichem maße.

Sie ziehen auf jeden fall von Ihrem Vorgehen nutzen: Sie generieren traffic für Ihren Kanal in großem maße – und online traffic ist die Grundlage für – möglicherweise erst späteres – monetarisieren.

Ich fordere Sie auf, das von Ihnen aus meinem filmmaterial generierte Artefakt unverzüglich aus dem netz zu nehmen, ansonsten ich von TikTok einen takedown beantragen werde.

ich habe das betreffende Video inzwischen von TikTok entfernt und werde Ihr Material nicht erneut veröffentlichen.

Ihre pauschale Beurteilung meiner übrigen Videos sowie die Unterstellung, ich würde historisches Material grundsätzlich respektlos behandeln oder als mein eigenes ausgeben, weise ich jedoch zurück. Ziel meiner Bearbeitungen ist es, historische Aufnahmen durch Schnitt und Kolorierung einem heutigen Publikum näherzubringen. Ob diese Form der Bearbeitung gefällt, ist selbstverständlich eine Frage der persönlichen Auffassung.

Ein erheblicher Teil des von mir verwendeten Materials stammt zudem aus historischen und nach meiner Prüfung gemeinfreien beziehungsweise zur entsprechenden Nutzung verfügbaren Quellen. Ihre Beanstandung habe ich dennoch respektiert und das Video entfernt.

Ich gebe Ihnen recht: Ihre Veröffentlichungen pauschal zu beurteilen, steht mir nicht zu.

Was mir aber eindeutig zusteht, ist, den Umgang mit meinem urheberrechtlich geschützten Filmmaterial zu beurteilen und für meine Rechte einzutreten.

Sie schreiben:

Meine Anmerkung dazu:

An dem zur Diskussion stehenden Beispiel des Simmering Videos: 

Die Generierung von views, clicks und online traffic durch croppen, Formatänderung, willkürliches editieren und automatisches kolorieren, Beifügung von text und Musik und die Veröffentlichung OHNE jede Information über urheber, nutzungsrechte und entstehungshintergrund sehe ich jedenfalls nicht als respektvollen Umgang mit tatsächlich historischem Bildmaterial.

Nachdem Sie offensichtlich eine große Anzahl von Materialien aus unterschiedlichen quellen hernehmen, Ihren Gutdünken nach frei „umarbeiten“ und unter Ihrem alias RAIN D anonym veröffentlichen, und das schon lange machen – unter der Prämisse:

kennen Sie sicher die entsprechenden gesetzlichen Grundlagen:

There, I made a film with some young people; I gave them my N-8 mm camera, and they filmed themselves, drove around the neighbourhood with the camera, and so on. We watched the finished film together, discussed it and screened it at the youth centre. Years later, I had the film digitised; I simply cut out the splices but did not edit it in any other way. The artist and musician Helmut Stadlmann contributed the music – I published the film on YouTube, where it was very well received. Following this, the Filmarchiv Austria asked me to submit this film to their platform, Filmarchiv Austria ON, where it was also published and viewed an extraordinary number of times. Yesterday, it was brought to my attention that a completely altered, colourised 1-minute version is circulating on TikTok. I tried to contact the uploader, who goes by the alias R.D. (abbreviated), but the message was not forwarded by TikTok on the grounds of an alleged breach (of my message!!) of community guidelines. “If I had to track everyone down and ask them first, I’d hardly be able to upload anything because almost nobody allows it or demands payment.”

“But I don’t earn anything from it; on the contrary, editing it actually costs me money – it’s purely a hobby.”

I don’t think that gentleman will agree either.

The video that you copied, edited in parts, changed the format of, colourised, added text and different music to, and published on TikTok without consulting me, without my written consent, and without any reference to copyright or the creator or background information – where it currently has 16.4 K views – this video

> was filmed 50 years ago now under my supervision and on my initiative by young people from the JZ Simmering at the Bunten Schule using my standard 8 mm camera; I purchased the film stock, had it developed and discussed the film with the young people

> I have properly archived and stored this analogue film for many years

> Many years later, I had this 8 mm film digitised – for a fee, of course

> About a year ago, I removed the splices (joints), but did not edit the film in any way

> A composer and musician set the film to music

> I published the film (you’ve probably downloaded it from YouTube) – it immediately attracted a great deal of interest

> I was subsequently contacted by Filmarchiv Austria and asked to hand over this film to Filmarchiv Austria for their ‘Filmarchiv ON’ platform – where it was published a few months ago and the trailer had more than 40,000 views within the first few days.

> I have been running the project ‘Das Ewige Archiv’ since 1980. www.ewigesarchiv.at – a very comprehensive, independent website – an encyclopaedia of contemporary realities, and I exhibit internationally.

> For more than 10 years, I have been producing documentaries, some of which are shown on ORF (see website, etc.)

> I am occasionally approached by film production companies – most recently by a German production company – regarding the licensing of footage, particularly historical material such as this footage that you have copied without permission and completely altered.

Note:

These are NOT YOUR videos that you are recolouring, cropping, trimming, editing, etc. – these films all HAVE copyright holders.

Films do not come into being by themselves.

“If I had to track everyone down and ask for permission first, I’d hardly be able to upload anything because almost nobody would allow it or would demand payment.”

Note:

This means: you assume – or know – that nobody would allow it – and so you avoid asking, whilst being convinced that you can do it anyway, or precisely because of that; in other words: you just go ahead and do it.

You flout copyright laws, use other people’s work without permission, alter it drastically, thoughtlessly and disrespectfully, modify (historical) material as you see fit – and publish your motley mix WITHOUT crediting the creators under YOUR pseudonym / avatar RAIN D

“But I don’t earn anything from it; on the contrary, editing it actually costs me money – it’s purely a hobby.”

Note:

Because you claim not to earn anything from it – your actions seem justified to you.

It is completely irrelevant to me and all other creators whether – or how much – you earn; in any case, the unauthorised use and alteration of the material also causes material damage to the creators – it devalues every piece of material to a considerable extent.

You are certainly benefiting from your actions: you are generating a huge amount of traffic for your channel – and online traffic is the basis for – possibly at a later stage – monetisation.

I demand that you immediately remove the content you have created using my film footage from the internet; otherwise, I will request a takedown from TikTok.

I have since removed the video in question from TikTok and will not republish your material.

However, I reject your sweeping judgement of my other videos, as well as the insinuation that I generally treat historical material disrespectfully or pass it off as my own. The aim of my edits is to make historical footage more accessible to a modern audience through editing and colourisation. Whether this form of editing is to one’s liking is, of course, a matter of personal opinion.

Furthermore, a significant proportion of the material I use comes from historical sources which, following my own checks, are in the public domain or available for such use. Nevertheless, I have respected your objection and removed the video.

I agree with you: it is not my place to make sweeping judgements about your publications.

However, I am clearly entitled to assess how my copyright-protected film material is being used and to stand up for my rights.

You write:

My comment on this:

Taking the Simmering video in question as an example:

I certainly do not regard the generation of views, clicks and online traffic through cropping, format changes, arbitrary editing and automatic colourisation, the addition of text and music, and publication WITHOUT any information about the copyright holder, usage rights or the background to the footage as a respectful way of handling genuinely historical visual material.

Given that you evidently take a large amount of material from various sources, ‘rework’ it freely as you see fit and publish it anonymously under your alias RAIN D – and have been doing so for a long time – on the premise that:

“If I had to track everyone down and ask for permission first, I’d be unable to upload almost anything because almost no one would allow it or would demand payment”

you are surely aware of the relevant legal principles:

> In Europe, copyright-protected material only enters the public domain 70 years after the death of the author
