Patriarchat angreifen und das Recht am eigenen Bild (DSVGO). Wien | AT · 2019 (© PP · Ewiges Archiv) Vor einigen Tagen sind mir Paste Ups mit großformatigen Fotodrucken aufgefallen. Abgesehen davon, dass Street Art, Graffiti, Paste Ups etc. ein umfangreiches Department im Ewigen Archiv ist und mich auch das Thema interessiert, hat mich die Frage beschäftigt, wieweit es zulässig wäre, diese Assemblagen – die ja an sich für „die Öffentlichkeit“ bestimmt sind, selbst zu veröffentlichen. Die Fotodrucke an den Wänden zeigen die Proponentinnen unverhüllt (mit einer Ausnahme), in gut ausgeleuchteten, scharfen Ganzkörperfotos, möglicherweise Studioaufnahmen. Es ist also davon auszugehen, dass die Dargestellten eingewilligt haben, dass diese Aufnahmen veröffentlicht werden. Kann jetzt aber ein*e Dritte*r diese Fotos ohne Unkenntlichmachung der Personen wieder – zB auf FB oder Instagram – veröffentlichen?

In addition to the fact that street art, graffiti, paste ups, etc. is an extensive department in the Eternal Archive and that I am also interested in the topic, I was concerned with the extent to which it would be permissible to use these assemblies – which in themselves are for “the public” are intended to publish themselves. The photo prints on the walls show the proponents openly (with one exception), in well-lit, sharp full-body photos, possibly studio shots. It can therefore be assumed that the subjects have given their consent to the publication of these recordings. But can a third party now publish these photos again without making the people unrecognizable – e.g. on FB or Instagram?
